Actual homes may differ in architectural details, colors, materials, landscaping, furnishings, dimensions, orientation, and other characteristics.

Only features and specifications expressly included in an executed purchase agreement or other applicable written agreement are contractually binding.

4. Artificial Intelligence Use & Content Review

Elan Homes may use artificial intelligence and other digital technologies to assist with marketing materials, written communications, illustrations, design concepts, administrative functions, and customer service.

Content prepared with AI assistance is subject to human review before publication or official use where appropriate. Despite our review efforts, AI-assisted materials may contain inaccuracies, omissions, or unintended representations.

AI-generated or AI-assisted content is not a guarantee of pricing, construction feasibility, design accuracy, product availability, or contractual specifications. We reserve the right to correct, clarify, modify, or withdraw inaccurate content, subject to applicable law and existing contractual obligations.

5. Customer-Submitted AI Content & Requests

We welcome customer questions, inspiration photos, design ideas, and supporting documents. AI-created or modified materials may contain inaccurate dimensions, unrealistic construction details, unavailable products, unsupported specifications, or information that cannot be independently verified.

We may use submitted materials to better understand a customer’s preferences or request. Receipt, review, discussion, or acknowledgment does not constitute acceptance, approval, confirmation of feasibility, or an agreement to perform any requested work.

We do not guarantee construction feasibility, specifications, pricing, timelines, or estimates based solely on AI-generated images, plans, documents, or descriptions. Proposed work must be independently evaluated and expressly accepted by Elan Homes in writing.

We may request clarification, supporting documentation, or professionally prepared plans, and may decline or limit discretionary responses to requests that are excessively lengthy, repetitive, impractical, unverifiable, or disproportionately burdensome to evaluate, including requests that appear substantially AI-generated.

This section does not limit obligations under an existing contract, applicable warranty, or law.

6. Website Communications & Electronic Information

Communications through our website, email, text messaging, or other electronic platforms are generally treated as inquiries or correspondence. Submission of designs, proposed terms, documents, or other materials does not constitute acceptance of any proposed conditions or obligations.

No employee communication, preliminary estimate, informal discussion, automated response, or AI-assisted message modifies an existing contract unless the modification is authorized and executed in accordance with the applicable agreement.

Home purchases, construction services, upgrades, selections, allowances, warranties, and other contractual matters are governed by applicable executed agreements and properly authorized written amendments.

Customer-submitted documents, proposed terms, design specifications, AI-generated content, and other materials do not become part of an agreement merely because they were submitted to, received by, reviewed by, or discussed with Elan Homes.

No informal communication, preliminary estimate, automated response, or AI-assisted correspondence constitutes acceptance of a proposed agreement or modification unless expressly authorized and executed in accordance with applicable contractual requirements.

In the event of a conflict between website content and an executed agreement, the executed agreement controls, subject to applicable law. Nothing here limits rights or obligations that cannot lawfully be waived or modified.
